Can a lawsuit be filed for misfileling and misrepresenting employee to the irs?

we have tried to get the employer to reclassify employee and replace 1099's with w 2's that should have been issued in the first place. he refuses to do so. he also refuse to issue quarterly statements from retirement fund.
